Notably, Mr. Kiczek has successfully litigated several cases, including Exit A Plus Realty vs. Zuniga in September 2007, which held that a Real Estate Broker’s commission is earned after expiration of the listing if the contract was between the same parties within the envelope expiration period of the listing. He also won a lawsuit in 1999 against the City of Bayonne to block the lease of city-owned waterfront property for use as a solid waste transfer station for New York City household garbage. Issues argued in this case included the interstate commerce clause, lack of jurisdiction of NJ D.E.P. and Hudson County Improvement Authority over out-of-state solid waste, and procedural and substantive defects in awarding lease by City and approval by Municipal Planning Board.
